One of the common emails I receive as a Social Media lawyer is about FTC Disclosure. Many people are confused as to why “some people” don’t seem to disclose that their social shares are part of a branded (read: paid) campaign. It seems that many people are confused about how much a hashtag communicates and that relationship to what the FTC requires as part of their disclosure rules.
So, today I’m trying to explain (again, in plain English) why Hashtags are not likely sufficient FTC Disclosure.
